Please read these Terms and Conditions carefully before using our website or engaging ProKitchens for commercial kitchen design, equipment, or installation services.
1. Acceptance of Terms
- By accessing or using the ProKitchens website (prokitchens.in) or engaging our services, you agree to be bound by these Terms and Conditions.
- These terms apply to all visitors, customers, and others who access or use our website and commercial kitchen services in India.
2. Services
- ProKitchens (a brand of Mahi Enterprises) provides commercial kitchen design, equipment supply, installation, and annual maintenance contracts (AMC) across India.
- All service quotes are indicative and subject to site visit, final specifications, and availability. A formal written agreement will be provided before project commencement.
- ProKitchens reserves the right to decline any project that does not align with our service capabilities or safety standards.
3. Equipment & Pricing
- All equipment specifications, brands, and models displayed on our website are for reference purposes. Final availability and pricing are subject to confirmation at the time of order.
- Equipment prices, if indicated, are exclusive of installation, commissioning, GST, and freight unless explicitly stated otherwise.
- ProKitchens sources equipment from authorised dealers and provides valid GST invoices for all purchases.
4. Payments
- Payment terms are specified in the project agreement. Typically: 30% advance, 60% on equipment delivery, and 10% on project completion.
- All payments must be made via bank transfer, cheque, or UPI to Mahi Enterprises. ProKitchens will not be liable for payments made to any other party.
- Delays in payment milestones may result in project timeline revisions.
5. Warranty & Liability
- Equipment warranties are as per the original manufacturer's terms. ProKitchens facilitates warranty claims but is not the manufacturer.
- ProKitchens installation workmanship carries a 12-month defect liability period from the date of project handover.
- ProKitchens shall not be liable for indirect, incidental, or consequential damages arising from equipment failure, delays, or service disruptions beyond our reasonable control.
6. Cancellation & Refunds
- Cancellation of an order after advance payment and procurement commencement may attract cancellation charges of up to 20% of the order value.
- Refund of advance payments (where applicable) will be processed within 30 working days after deducting applicable cancellation charges.
- No cancellation is permitted after equipment has been delivered to the project site.
7. Intellectual Property
- All content on this website, including text, images, logos, and kitchen design concepts, is the intellectual property of Mahi Enterprises / ProKitchens.
- You may not reproduce, distribute, or use our content without explicit written permission.
- Kitchen design drawings provided as part of a project proposal remain the property of ProKitchens until full payment is received.
8. Use of Website
- You agree not to use this website for any unlawful purpose or in a manner that could damage or overburden our servers.
- Quote request forms and contact forms must only be used for genuine commercial kitchen enquiries.
- ProKitchens reserves the right to terminate access to users who misuse the website.
9. Governing Law
- These Terms and Conditions are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of courts in New Delhi, India.
- In the event of a dispute, parties agree to first attempt resolution through mutual negotiation before initiating legal proceedings.
10. Changes to Terms
- ProKitchens reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with a revised date.
- Continued use of our website or services after changes constitutes your acceptance of the updated terms.
